I. Subject

Art. 1. These Terms and conditions, referred to herein as “Terms and Conditions”, are intended to regulate the relationship between EUROCOUNT SERVICES EOOD, referred to herein as “Provider” for brevity, owner of the webpage https://eurocount.bg/, referred to herein as the “Webpage” for brevity, and each of the users, referred to herein as the “User(s)” for brevity, of the webpage, with regard to the User’s use of the Webpage.

III. General Provisions

Art. 3. The Webpage and the services offered through it shall function under the rules described in the Terms and Conditions.
Art. 4. The Provider shall not guarantee the continuous operation of the Webpage, nor that it shall be free of errors.
Art. 5. The Provider reserves its right to terminate access to certain material (including, without limitation: photos, text, and others) published on the Webpage or the entire Webpage, without the User’s consent, for an unlimited period of time, according to plan or incidentally, without bearing any responsibility for any damages to the User as a result of termination.
Art. 6. The Provider reserves its right to modify, without prior notification, the structure or content of the Webpage. Changes shall become effective immediately after they are published on the Webpage.

IV. Characteristics of the Service

Art. 7. The main characteristics of the services provided to Users by the Provider through the Webpage, referred to herein for brevity as “Services” are as follows:
(1) The Provider makes the content published on the Webpage available for viewing and sharing. The Provider provides information about itself, its team, services offered by it, current offers, informational articles, contact information, presentation of its clients and partners, etc.
(2) The Provider provides an option to generate a phone call through functional buttons on the Webpage.
(3) The Provider provides an option to generate electronic inquiries by email through functional inquiry forms within the Webpage. The User should fill out the fields indicated by the Provider and select the “Send” button. When using this service, the Users should take into account, and by accepting these Terms and Conditions, are considered informed that use of this service does not automatically lead to the conclusion of a contract between the respective User and the Provider, i.e. sending an inquiry by email does not create an obligation for the Provider to provide a certain service and does not result in a contractual (obligatory) relationship between the Provider and the User. It should be considered that the respective User who sent an email inquiry to the Provider has only concluded a contract with the Provider for the provision of the given service upon receiving a confirmation in this regard from the Provider.
The Provider does not guarantee its ability to reply or the term in which one will be provided.
(4) The Provider provides an option to generate electronic inquiries through an email client used by the User via functional links on the Webpage. To this end, the User needs to select a specific functional link on the Webpage (place where the Provider’s email address is indicated and can be “clicked” on) opening a new window on the device used by him/her, where a message shall be entered by an email client set up on the device.
The Provider does not guarantee its ability to reply or the term in which one will be provided.
(5) The Provider provides an option to use a dynamic Google map integrated in the Webpage. This service shall be used in accordance with the applicable terms of use of Google Maps and Google Earth available at https://www.google.com/intl/bg_bg/help/terms_maps.html .
(6) The Provider provides an option for the User to sign up for a newsletter referred to herein as the “Newsletter”, in order to receive information articles, news, suggestions, offers, etc. from the Provider to an email address provided by the User in advance. By providing an email address in the respective fields within the Webpage, the User gives his/her express consent to receive the Newsletter. After providing his/her email address on the Webpage, the User shall receive an electronic message sent to the respective email address to confirm his/her consent to sign up for the Newsletter. If he/she confirms his/her consent to sign up using the received email message, the User shall be forwarded to a Webpage in a browser where he/she shall have an option to provide additional confirmation of his/her consent.
The Newsletter is provided for an indefinite period of time, and the electronic Newsletter messages sent by the Provider may have varying frequency.
The User may, at any time and without providing a reason, cancel the Newsletter service: (i) using an cancellation link placed in each electronic message of the Newsletter sent by the Provider to the User; (ii) by sending an email to the Provider clearly asking for cancellation to office@eurocount.bg; or (iii) by a written cancellation request sent by post to the Provider at: city of Sofia, 23, Aleksandar Malinov blvd., City Point TC, fl. 2, office 70.
(7) The Provider provides an option to book a consultation meeting using functional forms within the Webpage. The User should fill out the fields indicated by the Provider and select the buttons indicated for completion of the procedure. When using this service, Users must take into account, and by accepting these Terms and Conditions, are considered informed that use of this service does not automatically lead to the conclusion of a contract between the respective User and the Provider, i.e., filling out and sending the form does not create an obligation for the Provider to provide a certain service and does not result in a contractual (obligatory) relationship between the Provider and the User. It should be considered that the respective User who filled out a sign-up form with the Provider has only concluded a contract with the Provider for the provision of the given service upon receiving a confirmation in this regard from the Provider.
The Provider does not guarantee its ability to reply or the term in which one will be provided.

V. Intellectual Property Rights

Art. 8. (1) The entire information published on the Webpage, including, without limitation: text, photos, audio and video materials, is intellectual property of the Provider or used by the latter on lawful grounds, and as such is protected by current legislation on the protection of intellectual property, including, without limitation, protection of copyright and related rights.
(2) The Provider reserves all rights indicated in the paragraph above.
(3) Use of information indicated in par. 1 of this article, including, without limitation: copying, modification, reproduction, without the consent or the permission of the Provider or the respective holder of intellectual property rights, with the exception of cases expressly indicated by the law, is forbidden and comprises a violation of the Provider’s intellectual property rights or those of their respective holder, if different from the Provider.
Art. 9. The Webpage may contain names and brands of products, services or persons which comprise or may comprise trademarks owned by the Provider or third parties. Neither access to the Webpage, nor anything in these Terms and Conditions or the remaining content of the Webpage, shall be understood and/or construed as, and shall not comprise granting of a license or right to use any trademark without the prior written consent of the Provider or the respective third-party owner of the respective object of intellectual property.

VI. Other Conditions

Art. 10. (1) Information and materials available on the Webpage (including, without limitation: articles, images, messages, etc.) are of an informational, general or abstract nature, and do not comprise nor should be viewed or construed as advice, directions and/or consultation provided by the Provider to any of the Users of the Webpage.
(2) The Provider shall not bear any responsibility for the correctness, reliability, accuracy and/or current nature of information and materials available on and/or through the Webpage, in any regard, nor for their applicability to specific factual circumstances.
(3) The Provider shall not bear any economic and/or other responsibility for the content of the Webpage, nor shall it be responsible for damages suffered by any User and/or third party with regard to using the Webpage and/or information and materials available through it, including their application in a specific situation (e.g.: a User undertaking specific actions based on information posted on the Webpage).
Art. 11. Should any of the provisions of the Terms and Conditions prove invalid, this shall not invalidate the entire contract.
Art. 12. These Terms and Conditions shall become effective for all Users as of 31.08.2020. 13. The Terms and Conditions may be amended by the Provider at any time, and any change in the Terms and Conditions shall become effective for the Users without the need for express notification of the latter.
Art. 14. By using (including, without limitation: viewing, clicking on links, entering information, etc.) the Webpage and information on it, the User expresses his/her unconditional acceptance of the Terms and Conditions and all subsequent changes to them, and to be bound by them and comply with them.
